Revocation right for consumers

(A ‘consumer’ is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either their commercial or independent professional activities.)

Revocation right

You have the right to revoke this contract within 14 days without specifying any reasons.

The revocation period is 14 days with effect from the day:

  • on which you or a third party nominated by you, which is not the carrier, took possession of the products, provided you ordered one or more products within a standard order and they are delivered uniformly;
  • on which you or a third party nominated by you, which is not the carrier, took possession of the last product, provided you ordered several products within a standard order and they are delivered separately;
  • on which you or a third party nominated by you, which is not the carrier, took possession of the first product, provided products for regular delivery are delivered across a specific period.

You may use the model withdrawal form below, but this is not mandatory.

You can also exercise your right of withdrawal online using the “Revoke a contract” page on our website. If you use this online function, we will immediately send you confirmation of receipt on a durable medium, such as email, with information about the content of the cancellation declaration and the date and time it was received.

To meet the revocation deadline, it is sufficient for you to send the notification about exercising the revocation right before the revocation period expires.

Consequences of the revocation

If you revoke this contract, we shall repay all payments received from you, including delivery costs (except additional costs resulting from your selection of a delivery method other than the least expensive standard delivery offered by us), immediately and no later than 14 days from the day on which we receive your notification of revocation.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; you will not be charged any fees for this repayment.

We may refuse repayment until the products are returned to us or until you provide evidence that you have sent the products back, whichever is earlier.

You must return or transfer the products to us or to Chinature Logistik Zentrum, Oberlaaer Strasse 250, access via Sulzengasse 6, 1230 Vienna, Austria, immediately and no later than 14 days from the day on which you inform us of the revocation. The deadline is met if you send the products before the 14-day period expires.

You bear the direct costs of returning the products.

You must pay for any depreciation of the products only if it results from handling beyond what is necessary to check their condition, features and functionality.

Criteria for exclusion or expiry

The revocation right is not available for contracts:

  • for products that are not prefabricated and whose manufacture depends on an individual selection or specification by the consumer, or that are clearly tailored to personal requirements;
  • for products that can spoil quickly or whose use-by date would be exceeded quickly;
  • for alcoholic drinks whose price was agreed when the contract was concluded, which can be delivered only after 30 days and whose current value depends on market fluctuations beyond our control;
  • for newspapers, periodicals or magazines, except subscription contracts.

The revocation right expires prematurely for contracts:

  • for sealed products that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;
  • for products that have been inseparably mixed with other goods after delivery owing to their condition;
  • for sealed sound or video recordings or computer software if the seal has been removed after delivery.
